오픈소스소프트웨어(FOSS)와 관련하여 가장 인기있는 리파지토리(repository)이며, 수십만개의 오픈소스 프로젝트들이 수백만개의 저장소로 활용하고 있는 “GitHub”가 GitHub를 활용하고 있는 사용자들이 새로운 리파지토리를 만들때, 공인된 오픈소스 라이선스를 선택하여 사용하도록 유도하기 시작하였다. 이와 같은 계획의 일환으로, GitHub는 새로운 웹사이트(http://choosealicense.com/)를 개설하였다. 이웹사이트는 라이선스에 관한 간단한 설명과 함께 사용 가능한 라이선스에는 어떠한것들이 있는지에 대해 간단한 리스트를 제공한다.
금년도 상반기에 SFLC (Software Freedom Law Center)에서 근무를 하고 있던 변호사 론윌리엄슨(Aaron Williamson)은, GitHub의 리파지토리와 관련된 그의 분석보고서에서 GitHub의 리파지토리 대표 샘플들중 14.9%만이 그들이 어떠한 오픈소스 저작권 라이선스를따르고 있는지를 분명하게 밝히고 있다고 하였다.
GitHub의 규정에 따르면 사용자들은 다른사용자들의 코드를 열람하고 복제 할 수 있다. 하지만 그와 같은 규정이 있다고하여 GitHub의사용자가 GitHub에 등재된 다른 사용자의 코드를 복제, 변환 그리고 재배포 할 수 있는 라이선스를 자동적으로 취득하는 것은 아니다.
따라서 이와 같은 경우에 사용자들의 권리를 보호해 줄 수 있는 분명한 라이선스가 없는 이상, GitHub에 등재 되어있는 소스코드들은 어떠한 의미로든 진정한 프리소프트웨어(free software)나 오픈소스소프트웨어(open source software)로 볼 수가 없다.

GitHub, one of the most popular FOSS source code repositories, used by hundreds of thousands of FOSS projects in millions of repositories,now prompts users to select an approved FOSS license when they create a new repository. In coordination with this program, GitHub launched a new website that offers a small list of possible licenses with simple descriptions. Earlier this year Aaron Williamson, a lawyer then practicing at the Software Freedom Law Center, reported on his analysis of repositories at GutHub, showing that only 14.9% of a representative sample of repositories at GitHub clearly specified a FOSS copyright license. While GitHub's terms of service allows other users to view and copy code, that does not provide a license to copy, modify and redistribute the copyrighted works hosted there. Without an explicit license to protect those users' rights, code hosted at GitHub is not free software or open source software at all.
