미 대법원, 소프트웨어 특허성에 관한 중요 사건 심리

2013년12월6일, 미국 대법원이 앨리스 코퍼레이션(Alice Corporation Pty. Ltd) 대CLS은행의 소송 건에 대한 상고 신청을 수락했다. 해당 소송은 미 연방 항소 법원의 상고심으로 미국 내에서 소프트웨어의 특허 가능성 여부(patentability)와 관련된 이슈를 직접적으로 다루고 있다.
양측 당사자 및 “법정 조언자 의견서” (amici curiae)는 몇 주 이내로 제출 될 예정이며, 전체 기술 위원회는 향후에 일어나는 기술 발전의 추이를 예의 주시할 전망이다. 과거에 법정 조언자 의견서(amici curiae)를 제출 한 바 있는 SFLC (Software Freedom Law Center)는 이번 사건에서도 법정 조언자 의견서(amici curiae)를 제출 할 예정이다.

Supreme Court to Review Critical Case Concerning Patentability of Software

On December 6th 2013, the United States Supreme Court granted certiorari in the case of Alice Corporation Pty. Ltd. v. CLS Bank International, et al. This case, a patent appeal from the U.S. Court of Appeals for the Federal Circuit, deals directly with the issue of the patentability of software in the United States.
Briefs by both the parties and *amici curiae* are expected in the coming weeks and the entire technology community will likely be paying careful attention to further developments. Software Freedom Law Center which has filed Amicus Curiae briefs in the past will be filing in this case as well.
