본 문서를 자세하게 전체적으로 읽어보시오. 동봉된 프로그램은 본 CATOSL(Computer Associated Trusted Open Source License) (이하 라이선스”)의 조건에 의거하여 제공된다. 프로그램을 사용, 복제, 수정 또는 배포하는 행위는 수취인이 본 라이선스를 승낙했다는 의미를 구성한다. 

라이선스의 배경

Computer Associates International, Inc. (CA)는 오픈 소스를 신뢰한다. 우리는 오픈 소스 개발 접근법이 적절한 소프트웨어 프로그램의 품질과 성장, 혁신을 유례없는 수준으로 끌어올릴 수 있다고 믿는다. 오픈 소스에 대한 우리의 지속적인 노력과 참여를 보여주기 위해, (아래에 정의된 대로) 프로그램을 본 라이선스에 의거하여 릴리즈 하는 바이다.

본 라이선스는 프로그램의 기여자와 수취인이 자유롭게, 그리고 일부 다른 오픈 소스 라이선스의 많은 고려사항이 없이 소스코드를 포함하는 프로그램을 사용할 수 있도록 고안되었다. 우리는 기본 프로그램과 그 프로그램에 대한 (아래에 정의된) 기여물이 오픈 되기를 기대하지만, 본 라이선스는 당신이 그렇게 하기로 선택한 경우가 아니라면, 당신의 독자적인 소프트웨어 프로그램을 본 라이선스로부터 자유롭게 관리하는 것을 허용하도록 고안되었다. 따라서 프로그램에 대한 당신의 기여물만이 본 라이선스의 규정에 의해 배포되어야 한다.

1정의

11. 기여물이란 (a) CA의 경우, 원본 프로그램을, 그리고 (B) 각 기여자(CA 포함)의 경우에는 프로그램에 대한 변경사항과 추가사항으로서, 해당 기여자로부터 발생되어, 해당 기여자와 관련 없는 제3자에게 배포하는 것을 의미한다. 어떤 기여물은 그것이 어떤 기여자 자체에 의해, 혹은 그 기여자를 대신한 누군가에 의해 프로그램에 추가되었을 경우 그 기여자로부터 발생되는 것이다. 기여물은 프로그램에 대한 추가사항 중에서, (x) 독자적 라이선스에 따라 프로그램과 함께 배포된 소프트웨어의 독립된 모듈들, 그리고 (y) 프로그램으로부터 파생한 저작물이 아닌 프로그램은 포함하지 않는다. 

12. 기여자란 CA를 비롯하여 프로그램을 배포하는 모든 개인이나 주체를 의미한다.

13. 기여자 버전이란 어떤 기여자를 기준으로, 그 기여자의 기여물을 포함하나 그 이후에 프로그램에 더해진 기여물은 포함하지 않는 프로그램의 버전을 의미한다.

14. 복합저작물이란 프로그램이나 그 일부를, 본 라이선스의 규정에 의해 구속되지 않는 코드와 결합하는 저작물을 의미한다.

15. 라이선스 된 특허란 기여물을 단독으로 혹은 프로그램과 결합하여 사용하거나 판매함으로써 침해되는, 기여자에 의해 라이선스가 가능한 특허를 의미한다.

16. 원본 프로그램이란 소스코드, 오브젝트 코드 및 문서를 포함하는, 본 라이선스가 첨부된, CA가 릴리즈 한 소프트웨어의 원본 버전을 의미한다.

17. 프로그램이란 원본 프로그램과 기여물을 의미한다.

18. 수취인은 프로그램을 수정, 복제, 사용 또는 배포하는 모든 사람을 의미한다.

2권리의 부여

21.  본 라이선스의 조건에 구속되어, 각 기여자는 그 기여자의 기여물이나 파생물을 소스 코드와 오브젝트 코드의 형식으로 복제, 파생 저작물 작성, 전시, 공연, 배포 및 서브라이선스 설정할 수 있는 비독점적이고 전세계에서 사용료 없이 사용이 가능한 저작권 라이선스를 수취인에게 부여한다. 의혹을 방지하기 위해, 21항에서 제공되는 라이선스는 기여자의 라이선스 된 특허에 대한 라이선스는 포함하지 않는다.

22. 본 계약서의 규정에 구속되어, 각 기여자는 필요한 정도까지 해당 기여자의 기여물을 소스 코드나 오브젝트 코드의 형식으로 제조, 사용, 판매, 판매를 위한 청약, 수입할 수 있는 라이선스 된 특허에 대한, 전세계에서 무료로 사용이 가능한 라이선스를 수취인에게 부여한다. 22항에서 부여하는 라이선스는 만약 기여자가 기여물을 추가하는 시점에, 그러한 기여물의 추가행위로 인해 결합물이 라이선스 된 특허를 침해하는 경우에, 기여물과 프로그램의 결합물에 적용된다. 앞서 다룬 내용과 관계없이, 다음과 같은 경우에는 본 22항에 의해 어떠한 라이선스도 부여되지 않는다: (a) 이 문서의 규정에 따라 사용되고 존재하는 기여자 버전을 포함하지 않는 코드나 저작물의 경우; (b) (i) 기여자 버전에 대한 제3자의 수정, 또는 (ii) 각 기여자에 의해 만들어진 기여물과 다른 소프트웨어나 장치와의 결합물(기여자 버전의 일부로서 결합하는 것 제외)에 의해 야기된 침해의 경우, 또는 (c) 그 기여자에 의해 만들어진 기여물의 부재 시에 프로그램에 의해 침해된 라이선스 된 특허와 관련된 경우.

23 . 수취인은 제24항에 규정된 경우를 제외하고 각 기여자가 여기에 제시된 바에 따라 라이선스를 부여함에도 불구하고, 어떤 기여자에 의해서도 그 프로그램이 다른 개인이나 주체의 특허 또는 기타 지식재산권을 침해하지 않는다는 보장은 제공되지 않는다는 사실을 이해한다. 기여자는 다른 개인이나 주체가 지식재산권의 침해 등에 근거하여 제기한 청구에 대한 어떤 책임도 부인한다. 여기에서 부여되는 권리와 라이선스를 행사하기 위한 조건으로, 각 기여자는 필요한 경우 다른 사람의 지식재산권을 보호할 책임을 단독적으로 지는데 동의한다.

24 . 각 기여자는 자신의 기여물의 저작권에 대해 모든 권리와 자격, 이익을 소유한다는 사실, 그리고 본 라이선스에 제시된 저작권 라이선스들을 부여할 수 있는 권리를 지녔음을 선언하고 보증한다.

3. 배포 요구사항

31. 프로그램이 오브젝트코드의 형식으로 배포되는 경우, 프로그램에 대한 소스코드가 기여자로부터 제공된다는 사실과 소스코드를 구할 수 있는 방법과 장소를 설명하는 명시적인 고지가 코드 자체와 관련된 문서에 포함되어야 한다. 기여자는 다음과 같은 조건 하에 자신의 독자적인 라이선스 계약서에 따라 프로그램을 오브젝트코드로 배포할 수 있다:

?  본 라이선스의 규정과 조건을 준수해야 하고;

?  각 라이선스 계약서는:

?   모든 기여자들을 대신하여 소유권과 비침해에 대한 보증과 상품성여부와 특정 목적에 대한 적합성에 대한 묵시적 보증을 포함한 모든 종류의 묵시적이거나 명시적인 보증을 적용 가능한 법률이 허용하는 최대 한도까지 효과적으로 부인해야 한다; 또한

?   모든 기여자들을 이익의 손실과 같은 직접적이거나 간접적인 손해, 특수하거나 우발적이거나 결과적 손해를 포함하는 모든 손해로부터 효과적으로 면제시켜야 한다; 또한

?   본 라이선스와 모순된 모든 조항은 다른 당사자가 아닌 해당 기여자가 단독으로 제공하는 것임을 설명해야 한다; 또한

?   배포에 소요되는 비용을 지불하고 프로그램에 대한 그러한 소스코드를 해당 기여자로부터 구할 수 있다고 설명하고, 수취인이 그것을 구할 수 있는 적절한 방법을 알려줘야 한다. 

 

32. 프로그램이 소스코드 형식으로 제공되는 경우:

?  본 라이선스에 따라 구할 수 있어야 한다; 또한

?  프로그램의 각 복제본에 본 라이선스의 사본이 포함되어야 한다.

 

33. 본 라이선스는 어떤 기여자라도 프로그램의 상업적 배포를 용이하게 하기 위해 고안되었다. 그러나, 기여자는 수취인에게 프로그램의 배포에 대한 대가로 일회성의 선불 요금만 청구할 수 있다. 기여자는 수취인이 본 라이선스에 따라 프로그램에 대한 자신의 권리를 행사하는 행위에 대해 수취인에게 반복적인 요금이나 라이선스 수수료, 또는 지속적인 사용료 등을 부과할 수 없다. 기여자는 자신이 배포하는 기여자 버전에 대한 소스코드를 유료로 설정할 경우에는, 그 기여자가 저작물을 물리적으로 복제하고 배포하는데 소요된 비용과 동일한 비용으로 제공해야 한다. 기여자가 수취인에게 어떤 용역이나 관리에 대한 요금을 부과하는 것을 금지하는 것은 본 라이선스의 의도가 아니다. , 이는 그러한 요금이 앞에서 다룬, 프로그램 자체에 대한 사용료나 기타 반복적인 요금을 부과하는 것에 대한 제한 사항들을 우회하려는 시도가 아닌 경우로 한한다.

34. 기여자는 프로그램을 본 라이선스의 규정에 의해 구속되지 않는 다른 소프트웨어 코드와 결합함으로써 복합저작물을 만들고, 그 복합저작물을 단일한 제품으로 배포할 수 있다. 이 경우, 기여자는 프로그램에 대하여 본 라이선스의 요구사항들이 충족되도록 보장해야 한다. 복합저작물의 일부를 이루는 형태를 포함하여, 프로그램을 상업적인 제품의 제공에 포함시키는 모든 기여자는, 다른 기여자가 아닌 본인만이, 추가적 계약 조건을 체결할 수 있다. 추가적 계약 조건에는 해당 기여자의 작동 보증과 비침해 선언이 포함되나 이에 국한되지는 않는다. 어떤 기여자도 다른 기여자에 대한 추가적 의무를 생성시킬 수는 없다. 따라서, 어떤 기여자가 프로그램을 상업적 제품의 제공에 포함시키는 경우, 해당 기여자(상업적 기여자)는 상업적 기여자에 의해 배포된 프로그램에 기여물을 추가한 다른 모든 기여자(면책 기여자)에 대해, 면책 기여자를 상대로 제3자에 의해 제기된 청구, 소송 및 기타 법적 조처로 인해 발생한 손해와 손상, 비용(통칭하여 손실)으로부터 방어하고 면책하는데 동의한다. 이러한 면책의 범위는 추가적 계약조건을 포함하여, 해당 기여자의 프로그램 배포와 관련된 행위나 행위의 누락에 의해 야기된 정도까지이다.

35. 만약 기여자가 어떤 제3자의 지식재산권에 의해 부여된 특정 라이선스가 제21항과 22항에 따라 해당 기여자에 의해 부여되는 권리들을 행사하는데 요구된다는 사실을 알고 있다면, 기여자는 (a) 배포되는 프로그램 소스코드와 함께 ../IP_ISSUES 라는 제목의 텍스트 파일을 포함시켜야 하고, (b) CA에게 다음 주소로 이와 같은 내용을 서면이나 이메일로 통지해야 한다: 주소: Computer Associates International, Inc., One Computer Associates Plaza, Islandia, New York 11749, Attn: Open Source Group / 이메일 주소: opensource@ca.com. 둘 중 어떤 방법을 쓰더라도, 청구와 청구를 제기한 당사자에 대한 내용을 충분히 자세한 정도로 설명하여, CA와 수취인이 그 문제에 관하여 누구에게 연락을 취해야 하는지를 알 수 있게 해야 한다. 만약 기여자가 그러한 사실을 기여물이 이미 통용된 이후에 알게 된다고 하더라도, 기여자는 그 이후로 제공하는 모든 복제본의 IP_ISSUES 파일을 즉각적으로 수정하고, 프로그램을 양도받는 사람에게 이러한 새로운 정보가 입수되었다는 사실을 알려주도록 적절하게 고안된 (관련된 메일링 리스트나 온라인 그룹에 통지하는 등) 기타 다른 조치를 취해야 한다.

36. 수취인은 프로그램에 나타나는 CA 또는 다른 기여자의 저작권이나 특허 소유권 통지를, 그것이 소스코드, 오브젝트코드 또는 기타 문서이든지 관계없이, 제거하거나 눈에 띄지 않게 가리거나 수정하지 않는다. 4조에 제시된 의무에 추가하여, 각 기여자는 후속 수취인이 기여물의 창작자를 식별할 수 있는 적절한 방식으로 본인이 기여물의 창작자라는 사실을 밝혀야 한다.

4기여의 제한사항CONTRIBUTION RESTRICTIONS

41. 각 기여자는 기여자가 기여물을 제공하는 프로그램 내에 기여자가 자신의 버전을 만들기 위해 가한 변경사항들과 변경의 날짜를 기록하는 파일을 포함시켜야 한다. 또한 각 기여자는 기여물이 직접적으로나 간접적으로 선행 기여자에 의해 배포된 프로그램으로부터 파생되었다는 사실과 그러한 기여물이 파생된 선행 기여자의 이름을 (a) 프로그램의 소스코드, 그리고 (b) 기여자가 프로그램의 유래나 소유권을 설명하는 실행파일 버전의 공지사항이나 관련된 문서에 포함시켜야 한다.

5보증 없음

51. 본 라이선스에서 명시적으로 제시된 경우를 제외하고, 프로그램은 있는 그대로 현재의 상태와 조건으로 제공된다. 프로그램의 상태, 품질, 지속성, 작동능력, 비침해, 상품성 여부 또는 특정 목적이나 사용에 대한 적합성에 대하여 어떠한 보증이나 선언, 조건, 약속, 규정도 명시적으로나 묵시적으로 어떤 기여자에 의해서도 제공되거나 인수되지 않으며, 그러한 모든 보증, 선언, 조건, 약속 및 규정은 법률이 허용하는 한도 내에서 최대한으로 배제된다.

52. 각 수취인은 프로그램의 사용과 배포에 대한 적합성을 결정하는 데 있어 전적인 책임을 지며, 본 라이선스에 따른 권리의 행사와 관련된 모든 위험을 감수한다. 여기에는 프로그램 오류, 적용 가능한 법률의 준수, 데이터나 프로그램 또는 장비의 손상이나 손실, 그리고 작동 불능이나 작동중지의 위험과 비용이 포함되나 이에 국한되지는 않는다.

53. 각 수취인은 프로그램이 오류가 발생할 경우 사망이나 개인적 상해, 심각한 물리적, 환경적 손해를 유발할 수 있는 핵 시설의 구동이나 항공기의 항해, 통신망, 또는 항공교통관제기의 사용을 위해 고안되지 않았다는 사실을 인식한다.

6책임의 부인

61. 손해 가능성을 사전에 알고 있는 경우라도, 본 라이선스에 명시적으로 제시된 경우를 제외하고, 법률이 허용하는 한도 내에서, 어떠한 기여자도 프로그램의 사용이나 배포, 혹은 여기에서 부여된 권리의 행사와 관련하여 발생한 직접적이거나 간접적인 손해, 우발적이거나 특수한 손해, 일반적이거나 우발적인 손해(이익 손실을 제한 없이 포함)에 대하여, 그것이 야기된 원인이나 어떤 의무론, 계약, 무과실책임, 불법 행위(과실 등을 포함)에 관계없이, 어떠한 책임도 지지 않는다.

7상표와 브랜드 TRADEMARKS AND BRANDING

71. 본 라이선스는 어떤 수취인이나 제3자에게 http://www.ca.com/catrdmrk.htm 에 현재 등록되어 있거나 추후에 등록되는 상표나 상호, 또는 CA가 소유하는 기타 상표, 서비스표, 로고나 상호(통칭하여 CA 상표), 또는 어떤 기여자가 소유하는 상표, 서비스표, 로고 및 상호를 사용할 수 있는 어떠한 권한도 부여하지 않는다. 수취인은 원본 프로그램으로부터 파생된 제품에 이름을 붙이거나 원본 프로그램으로부터 파생된 제품을 홍보하는데 어떠한 CA 상표도 사용하지 않는 데 동의한다.

72. 71항에 의해 구속되어, 수취인은 모든 저작권 및 기타 귀속 통지가 프로그램 내에 유지된다는 조건 하에, 수취인이 소유한 상표나 로고, 제품 명에 따라 프로그램을 배포할 수 있다.

8특허 소송

81.  수취인이 다른 개인이나 주체를 상대로 프로그램 자체(프로그램을 다른 소프트웨어나 하드웨어와 결합한 결합물은 제외)가 해당 수취인의 특허를 침해한다는 내용의 (교차 청구나 반소를 포함하는) 특허 소송을 제기하는 경우, 22항에 따라 해당 수취인에게 부여된 권리는 그러한 소송이 제기된 날을 기준으로 종료된다. 

9소유권

91. 본 라이선스의 제2 1항과 22항에 의해 부여된 라이선스에 의해 구속되어, 각 기여자는 그 기여자에 의해 작성된 모든 기여물에 대한 권리와 소유권, 이익을 보유한다. CA는 원본 프로그램과 CA에 의해 작성되거나 CA을 위해 작성된 기여물(CA 기여물)에 대한 모든 권리와 소유권, 이익을 보유하며, 그러한 CA 기여물은 자동적으로 본 라이선스에 의해 구속되지는 않는다. CA는 임의 재량으로, 그러한 CA 기여물을 본 라이선스에 따라 라이선스 설정하거나, 본 라이선스와 다른 규정에 따라 라이선스 설정하거나, 아예 라이선스 설정을 하지 않을 수도 있다.

10종료

101. 수취인이 본 라이선스의 실질적인 규정과 조건 중 어느 한가지라도 위반하고, 그러한 위반 사실을 인지한 날로부터 적절한 시일 내에 위반 내용을 교정하지 않았을 경우, 본 라이선스에 의한 수취인의 모든 권리는 종료된다. 본 라이선스에 따른 수취인의 권리가 종료된다면, 수취인은 프로그램의 사용과 배포를 가능한 빠른 시일 내로 중지한다는 데 동의한다. 그러나 본 라이선스가 종료하더라도, 라이선스에 따른 수취인의 의무와 수취인이 기여자로서 프로그램에 관련하여 부여한 라이선스들은 효력이 지속될 것이다.

11. 일반사항

111. 본 라이선스의 어떤 조항이 적용 가능한 법률에 의해 무효하거나 집행이 불가능할 경우, 그것이 본 라이선스의 나머지 조항의 유효성이나 집행 가능성에 영향을 주지는 않는다. 또한, 각 당사자에 의해 추가적 조치가 없는 한, 그러한 조항들은 그 조항을 유효하고 집행 가능하게 만들기 위해 필요한 최소한의 정도까지 개정된다.

112. CA는 때때로 본 라이선스의 신규 버전(개정판 포함)을 공표할 수 있다. 라이선스의 신규버전들은 각각 버전 넘버를 통해 구별된다. 프로그램(기여물 포함)은 언제나 그것이 양도된 라이선스의 버전에 따라 배포될 수 있다. 또한, 라이선스의 신규 버전이 공표된 이후에는 기여자가 선택적으로 프로그램(기여물 포함)을 신규 버전에 따라 배포할 수도 있다. 본 라이선스를 수정할 수 있는 권리는 CA에게만 주어진다.

113. 법률이나 법령 또는 규제로 인해 수취인이 프로그램의 전체나 일부에 대하여 본 라이선스의 규정을 준수하는 것이 불가능할 경우, 수취인은 (a) 가능한 최대한도로 본 라이선스의 규정을 준수하고; (b) 제한사항과 그것이 영향을 미치는 코드를 설명해야 한다. 이러한 설명은 제35항에 설명된 IP_ISSUES 파일에 포함되어야 하며, 프로그램 소스코드를 배포하는 모든 경우에 포함되어야 한다. 법률이나 규제에 의해 금지된 정도를 제외하고, 그러한 설명은 보통의 능력을 가진 수취인이 이해하는데 충분할 정도로 자세하게 이루어져야 한다.

114. 본 라이선스는 뉴욕주의 법률에 의해 구속된다. 어떤 수취인도 본 라이선스에 따른 법정 소송과 관련하여, 그 소송의 원인이 발생한 지 1년이 지난 이후에는 소송을 제기하지 않는다. 각 기여자는 결과적으로 일어난 소송의 배심 재판에 대한 자신의 권리를 포기한다. 본 라이선스와 관련하여 수취인과 CA 사이에서 일어나는 모든 분쟁의 해결은 뉴욕 주에서 이루어져야 하며, 수취인과 CA는 본 라이선스와 관련하여 해당 지구의 주 법원과 연방 법원의 재판관할에 동의한다. 국제물품매매에 대한 UN 협약의 적용은 명시적으로 배제된다.

115. 수취인이 캐나다 퀘벡에 거주하는 경우, 다음과 같은 규정이 적용된다: 당사자들은 그들이 본 라이선스와 모든 관련 문서가 영어로 작성되도록 요구했다는 사실을 확인한다. Les parties contractantes confirment qu'elles ont exige que le present contrat et tous les documents associes soient rediges en anglais.

116. 프로그램은 수취인이 프로그램을 양도받는 국가의 모든 수출법과 수입 법 및 규칙과 규정에 의해 구속된다. 수취인은 그러한 법률, 규칙, 규제를 위반하거나 필요한 라이선스나 허가를 갖추지 않고 프로그램을 수출, 재수출, 또는 수입하지 않는다는 사실을 준수하고 보장하는데 전적인 책임을 진다. 

117. 본 라이선스는 그 내용에 대한 당사자들간의 전적인 합의를 구성한다.

1. DEFINITIONS

1.1 Contribution means (a) in the case of CA, the Original Program; and (b) in the case of each Contributor (including CA), changes and additions to the Program, where such changes and/or additions to the Program originate from and are distributed by that particular Contributor to unaffiliated third parties. A Contribution originates from a Contributor if it was added to the Program by such Contributor itself or anyone acting on such Contributors behalf. 2.4 Each Contributor represents and warrants that it has all right, title and interest in the copyrights in its Contributions, and has the right to grant the copyright licenses set forth in this License.

3. DISTRIBUTION REQUIREMENTS

3.1 If the Program is distributed in object code form, then a prominent notice must be included in the code itself as well as in any related documentation, stating that the source code for the Program is available from the Contributor with information on how and where to obtain the source code. 8.1 If Recipient institutes patent litigation against any person or entity (including a cross-claim or counterclaim in a lawsuit) alleging that the Program itself (excluding combinations of the Program with other software or hardware) infringes such Recipients patent(s), then such Recipients rights granted under Section 2.2 shall terminate as of the date such litigation is filed.

9. OWNERSHIP

10. TERMINATION

A Contributor may choose to distribute the Program in object code form under its own license agreement, provided that:

If Contributor obtains such knowledge after the Contribution is made available, Contributor shall also promptly modify the IP_ISSUES file in all copies Contributor makes available thereafter and shall take other steps (such as notifying appropriate mailing lists or newsgroups) reasonably calculated to inform those who received the Program that such new knowledge has been obtained.

Recipient is solely responsible for complying with and ensuring that Recipient does not export, re-export, or import the Program in violation of such laws, restrictions or regulations, or without any necessary licenses and authorizations.

116. 프로그램은 수취인이 프로그램을 양도받는 국가의 모든 수출법과 수입법 규칙과 규정에 의해 구속된다. 수취인은 그러한 법률, 규칙, 규제를 위반하거나 필요한 라이선스나 허가를 갖추지 않고 프로그램을 수출, 재수출, 또는 수입하지 않는다는 사실을 준수하고 보장하는데 전적인 책임을 진다. 

11.7 This License constitutes the entire agreement between the parties with respect to the subject matter hereof.

1.1 Contribution means (a) in the case of CA, the Original Program; and (b) in the case of each Contributor (including CA), changes and additions to the Program, where such changes and/or additions to the Program originate from and are distributed by that particular Contributor to unaffiliated third parties. A Contribution originates from a Contributor if it was added to the Program by such Contributor itself or anyone acting on such Contributors behalf. Contributions do not include additions to the Program which: (x) are separate modules of software distributed in conjunction with the Program under their own license agreement, and (y) are not derivative works of the Program.

11. 기여물이란 (a) CA 경우, 원본 프로그램을, 그리고 (B) 기여자(CA 포함) 경우에는 프로그램에 대한 변경사항과 추가사항으로서, 해당 기여자로부터 발생되어, 해당 기여자와 관련없는 3자에게 배포하는 것을 의미한다. 어떤 기여물은 그것이 어떤 기여자 자체에 의해, 혹은 기여자를 대신한 누군가에 의해 프로그램에 추가되었을 경우 기여자로부터 발생되는 것이다. 기여물은 프로그램에 대한 추가사항 중에서, (x) 독자적 라이선스에 따라 프로그램과 함께 배포된 소프트웨어의 독립된 모듈들, 그리고 (y) 프로그램으로부터 파생한 저작물이 아닌 프로그램은 포함하지 않는다. 

1.2 Contributor means CA and any other person or entity that distributes the Program.

12. 기여자 CA 비롯하여 프로그램을 배포하는 모든 개인이나 주체를 의미한다.

1.3 Contributor Version means as to a Contributor, that version of the Program that includes the Contributors Contribution but not any Contributions made to the Program thereafter.

13. 기여자 버전이란 어떤 기여자를 기준으로, 기여자의 기여물을 포함하나 이후에 프로그램에 더해진 기여물은 포함하지 않는 프로그램의 버전을 의미한다.

1.4 Larger Work means a work that combines the Program or portions thereof with code not governed by the terms of this License.

14. 조합 저작물이란 프로그램이나 일부를, 라이선스의 규정에 의해 구속되지 않는 코드와 결합하는 저작물을 의미한다.

1.5 Licensed Patents mean patents licensable by a Contributor that are infringed by the use or sale of its Contribution alone or when combined with the Program.

15. 라이선스된 특허란 기여물을 단독으로 혹은 프로그램과 결합하여 사용하거나 판매함으로써 침해되는, 기여자에 의해 라이선스가 가능한 특허를 의미한다.

1.6 Original Program means the original version of the software to which this License is attached and as released by CA, including source code, object code and documentation, if any.

16. 원본 프로그램이란 소스코드, 오브젝트 코드 문서를 포함하는, 라이선스가 첨부된, CA 릴리즈한 소프트웨어의 원본 버전을 의미한다.

1.7 Program means the Original Program and Contributions.

17. 프로그램이란 원본 프로그램과 기여물을 의미한다.

1.8 Recipient means anyone who modifies, copies, uses or distributes the Program.

18. 수취인 프로그램을 수정, 복제, 사용 또는 배포하는 모든 사람을 의미한다.
