‘수정하다’

관련 법규 하에서 파생 저작물을 생산하기 위한 일정한 과정을 적용하는 것.

 

배포

저작물의 전체나 부분을 사람들이 이용할 수 있도록 복제하는 것. 배포는FTP 나HTTP 또는NFS같은 파일 전송 프로토콜에 의해 접근 가능한 저작물의 전자적인 요소로의 복제도 포함한다.

 

컴파일된 저작물

저작물이 컴퓨터에서 바로 이용 가능한 형태로 프로세스된 것을 말한다. 이 프로세스는 저작물에 의해 제공된 설치 기능들과 저작물의 변환, 저작물의 요소들의 복제, 그리고 다른 활동들을 포함한다. 저작물에 의해 제공된 설치 기능들에 의한 수정은 저작물의 수정을 구성한다.

 

현재의 관리자

저작물 내에서 임명된 사람 또는 사람들. 만약 그런 임명이 따로 없다면 관련 법규상 저작자가 현재의 관리자이다.

 

베이스 인터프리터

보통 저작물의 전체 또는 일부를 실행하거나 해석하는데 필요한 프로그램 또는 프로세스.

베이스 인터프리터는 외부 요소들에 의존하고 있지만 각각의 외부 요소들이 그 자체로 명확하게 식별가능하다면 이를 베이스 인터프리터의 일부로 보지는 않는다. 저작물에 라이선스를 적용할 때 명백하게 특정되지 않는 이상, 해당되는 베이스 인터프리터는`LaTeX-Format' 이거나`LaTeX-Format'에 속하는 파일들일 경우는`TeX language' 실행 프로그램이다.

 

 

 

배포와 수정에 관한 조건들

 

1. 배포 이외의 다른 활동은 본 라이선스가 다루는 범위가 아니다. 특별히, 저작물을 실행하는 행위는 자유롭게 할 수 있고 저작물에 대한 지원을 제공하는 것과 관련해서는 아무런 요구사항도 존재하지 않는다.

 

2. 당신은 당신이 저작물을 받았을 때의 상태 그대로, 아무런 수정을 가하지 않은 채로 배포할 수 있다. 저작물의 일부만을 배포하는 행위는 수정으로 간주되며, 그러한 파생 저작물을 본 조항의 조건들을 구비하지 않고 배포할 수 없다.

1) 만약 이러한 파생 저작물의 요소가 베이스 인터프리터와 함께 쓰이는 요소를 직접적으로 교체한 것이라면, 저작물의 이 요소가 베이스 인터프리터와 상호적으로 사용될 때 유저들에게 요소 자체를 식별할 수 있게 하는 모든 경우에, 파생 저작물의 교체된 요소는 베이스 인터프리터와 상호적으로 사용될 때 명확하게 그리고 분명하게 저작물의 수정된 버전임을 식별할 수 있게 해야 한다.

 

2) 파생 저작물의 모든 요소들은 그 요소의 교체를 자세히 설명하는 분명한 고지사항을 포함하거나, 파생 저작물의 일부로서 배포되어지고 완벽하고 자세한 교체에 대한 로그를 담고 있는 참조사항을 포함해야 한다.

 

3) 파생 저작물은 저작물의 오리지널 버전의 저작자(이에 국한되지는 않음)나 에러들을 보고하거나 고치는데 도움을 준 사람들(이에 국한되지는 않음)을 포함하여 이와 관련된 인물을 암시하는 정보를 담을 수 없다. 단, 도움을 제공한 사람들이 자신들이 분명하게 파생 저작물에 도움을 주었음을 밝힌 경우는 예외로 한다.

 

4) 당신은 파생 저작물을 배포할 때 다음 사항 중 적어도 한 가지를 같이 배포해야 한다.

 

 (1) 완전하고 수정되지 않은 저작물; 만약 당신의 수정된 요소의 배포가 지정된 장소에 접근을 제공하여 복제되는 방법으로 이루어진다면, 저작물에 대해서도 동일하거나 비슷한 장소를 통해 배포될 수 있도록 접근을 제공해야 한다. 이는 제3자가 수정된 요소들과 함께 저작물을 복제하도록 강제되지 않아도 마찬가지이다.

 

(2) 완전하고 수정되지 않은 저작물을 복제하는데 필요한 충분한 정보

 

 

7. 만약 당신이 현재의 관리자가 아니라면, 당신은 모든 수령인에게 파생 저작물을6항의 조건에 맞게 배포하는 경우에만 파생 저작물로부터 만들어진 컴파일된 저작물을 배포할 수 있다.

 

8. 위의 조건들은 수정을 막음으로써 어떤 식으로든 위 조항4의 현재의 관리자에 의해서 업데이트된 형태와 동일하게 저작물을 유지하려는 의도에서 만들어진 것은 아니다.

 

9. 다른 포맷으로 된 저작물이나 파생 저작물의 배포는, 저작물 또는 파생 저작물(전부 또는 일부)이 그 포맷으로 되기 위해 어떤 프로세스를 수행했던지, 이 라이선스의 어떤 항목도 완화해주거나 무효화하지 않는다. 

 

10.

1) 파생 저작물은 라이선스 그 자체가 위의 조항6에 열거된 조건들을 구비했다면 다른 라이선스 하에서 배포될 수 있다. 저작물 배포의 경우는 이 라이선스의 나머지 조건들을 구비하지 않아도 된다.

 

2) 만약 파생 저작물이 다른 라이선스 하에 배포된다면, 그 파생 저작물은 모든 수령자가 저작물 수정과 관련하여 위 조항6의 제한을 준수하여 수정을 실시할 수 있도록 충분한 문서를 제공해야 한다.    

 

11. 이 라이선스는 저작물과 관련되지 않은 다른 저작물에 대해선 어떠한 제한도 하지 않으며, 그러한 저작물들을 해당 저작물과 종합하는 것에 대해서도 마찬가지이다.

 

12. 이 라이선스의 어떤 부분도 당사자들이 관련 법규를 완전하게 준수하는 것을 막으려 의도된 것이 아니며, 이를 위해 사용될 수도 없다.

 

 

 

보증의 부인

 

저작물을 위한 보증은 없다. 서면으로 명확하게 남겨진 경우를 제외하고, 저작권자는, 특정 목적이나 상업성 등을 포함해서 어떤 종류의 보증도 없이(명시적이든 암묵적이든 상관없이), 저작물을‘있는 그대로’ 제공한다. 저작물의 품질과 성능에 대한 모든 위험은 당신이 부담해야 한다. 저작물에 결함이 있는 경우, 당신이 이를 교정하고, 서비스하는데 필요한 비용을 부담해야 한다. 

 

관련 법규가 정하고 있거나 서면으로 약정한 경우가 아니면 저작권자나 기여자(저작물의 요소들의 저자, 저작물을 수정하여 배포한 자등을 포함)는 어떠한 경우에도 이 저작물의 사용으로 인하여 발생한, 직접적이거나 간접적인 손해, 우발적이거나 결과적 손해, 특수하거나 일반적인 손해에 대하여, 그 발생의 원인이나 책임론, 계약이나 무과실책임이나 불법행위(과실 등을 포함)와 관계없이 책임을 지지 않는다. 이는 저작권자나 기여자가 이러한 손해의 가능성에 대해 충고를 받은 경우에도 마찬가지이다.

 

 

 

저작물의 관리

 

저작권자가 명확하고 분명하게 저작권 공지에 저작물은 오직 저작권자를 통해서만 관리될 수 있다고 명시하거나 또는 단순히`author-maintained' 라고 명시한 경우, 저작물은`author-maintained' 상태이다.

 

만약 저작물에 명시된 현재의 관리자가 있고 이들이 저작물과 관련된 에러 보고들을 받고 있다면(예를 들면 자신들의 유효한 이메일 주소 등을 남겨두는 식으로), 저작물은`maintained' 상태이다.

 

현재의 관리자가 없거나 명시된 현재의 관리자가 제시한 방법으로6개월 동안 연락이 되지 않고 다른 뚜렷한 관리에 대한 표시들이 존재하지 않는다면, 저작물은`maintained' 상태에서`unmaintained' 상태가 된다.

 

당신은 임명과 관련된 업무를 책임지는 현재의 관리자에게 동의를 얻음으로써 현재의 관리자가 될 수 있다.

 

만약 저작물이unmaintained상태라면, 당신은 다음의 과정을 거쳐서 현재의 관리자가 될 수 있다:

 

1. 인터넷이나 다른 비슷한 방법을 통해 현재의 관리자를 찾기 위한 상당한 시도를 할 것.(만약 저작권자가 다르다면 둘 다에게 시도를 해야 한다.)

 

2. 만약 찾는 것에 성공한다면, 저작물이 현재 관리되는 상태인지 물어야 한다.

 

1) 만약 관리되고 있는 상태라면, 현재의 관리자에게 새로운 연락 방법을 한 달내에 업데이트 하도록 요구해야 한다.

 

2) 만약 찾는 것에 실패하거나 현재의 관리자에 의해 관리의 재개를 위한 어떤 행동도 취해지지 않는다면, 당신이 관리를 하겠다는 의도를 적절한 커뮤니티에 공지해야 한다.(예를 들어, 만약 저작물이LaTeX work라면, comp.text.tex에 포스팅을 하면 될 것이다.)

 

3.       

1) 만약 현재의 관리자와 연락이 닿아서 당신에게 관리 권한을 주는 것에 동의했다면, 이는 그 발표 즉시 효력이 발생한다.

 

2) 만약 현재의 관리자와는 연락이 닿지 않고 저작권자가 당신에게 관리권한을 주는 것에 동의했다면, 이 경우도 그 발표 즉시 효력이 발생한다.

 

4. 만약 당신이2의2(2b)에 있는 관리를 하겠다는 의도를 적절한 커뮤니티에 공지했고3개월 안에 현재의 관리자나 저작권자 또는 다른 사람들로부터 아무런 제재를 받지 않는다면 저작물에 당신의 이름을 현재의 관리자로 바꿀 수 있다.

 

5. 만약3의2(3b)나4에 의해 완전히 이름을 바꾼 후에, 연락이 되지 않던 관리자가3개월 내에 한 번 이상 연락이 된다면, 요청에 의해 그가 다시 현재의 관리자가 되거나 관리자로 추가되어야 하며 이 경우 다시 복귀된 관리자는 한 달 안에 새로운 연락 방법을 업데이트해야 한다.

 

현재의 관리자의 교체 또는 변경은 저작물이LPPL license 하에 배포된다는 사실에는 아무런 영향을 끼치지 못한다.

저작물을 구성하는 것들의 규정

 

LPPL은 저작물을 배포할 때에 저작물의 모든 파일들을 포함할 것을 요구하고 있다. 따라서 당신이 라이센시에게 저작물이 어떤 파일들로 구성되어 있는지를 확인할 수 있는 방법을 제공하는 것이 매우 중요하다. 예를 들어, 저작권이 공시되는 곳의 근처에 저작물을 구성하는 파일들의 리스트를 명시하거나 따로 리스트 파일을 만든 뒤 아래와 같은 문장을 삽입하면 된다.

MAINTENANCE OF THE WORK

The Work has the status `author-maintained' if the Copyright Holder explicitly and prominently states near the primary copyright notice in the Work that the Work can only be maintained by the Copyright Holder or simply that it is `author-maintained'.

The Work has the status `maintained' if there is a Current Maintainer who has indicated in the Work that they are willing to receive error reports for the Work (for example, by supplying a valid e-mail address). It is not required for the Current Maintainer to acknowledge or act upon these error reports.

The Work changes from status `maintained' to `unmaintained' if there is no Current Maintainer, or the person stated to be Current Maintainer of the work cannot be reached through the indicated means of communication for a period of six months, and there are no other significant signs of active maintenance.

You can become the Current Maintainer of the Work by agreement with any existing Current Maintainer to take over this role.

If the Work is unmaintained, you can become the Current Maintainer of the Work through the following steps:

  1. Make a reasonable attempt to trace the Current Maintainer (and the Copyright Holder, if the two differ) through the means of an Internet or similar search.
  2. If this search is successful, then enquire whether the Work is still maintained.
    1. If it is being maintained, then ask the Current Maintainer to update their communication data within one month.
    2. If the search is unsuccessful or no action to resume active maintenance is taken by the Current Maintainer, then announce within the pertinent community your intention to take over maintenance. (If the Work is a LaTeX work, this could be done, for example, by posting to comp.text.tex.)
    1. If the Current Maintainer is reachable and agrees to pass maintenance of the Work to you, then this takes effect immediately upon announcement.
    2. If the Current Maintainer is not reachable and the Copyright Holder agrees that maintenance of the Work be passed to you, then this takes effect immediately upon announcement.
  3. If you make an `intention announcement' as described in 2b. above and after three months your intention is challenged neither by the Current Maintainer nor by the Copyright Holder nor by other people, then you may arrange for the Work to be changed so as to name you as the (new) Current Maintainer.
  4. If the previously unreachable Current Maintainer becomes reachable once more within three months of a change completed under the terms of 3b) or 4), then that Current Maintainer must become or remain the Current Maintainer upon request provided they then update their communication data within one month.

A change in the Current Maintainer does not, of itself, alter the fact that the Work is distributed under the LPPL license.

If you become the Current Maintainer of the Work, you should immediately provide, within the Work, a prominent and unambiguous statement of your status as Current Maintainer. You should also announce your new status to the same pertinent community as in 2b) above.

`Base Interpreter'

Unless explicitly specified when applying the license to the Work, the only applicable Base Interpreter is a `LaTeX-Format' or in the case of files belonging to the `LaTeX-format' a gram         implementing the `TeX language'.
