이 재버 오픈 소스 라이선스 (“라이선스”)는 재버 서버와 관련된 소프트웨어 제품을 비롯하여 Jabber.com, Inc.(“라이센서)에 의해 배포되는 해당 소프트웨어에 대한 업데이트나 유지관리 릴리즈 (“재버 제품”)에 적용된다. 본 라이선스를 따르는 모든 재버 제품은 라이선스된 제품이다. 라이선스된 제품은 전부 미국 저작권법에 의해 보호된다. 본 라이선스는 당신이 라이선스된 제품을 사용, 복제, 배포 또는 수정할 수 있는 규정을 정의한다.

서문

이 서문은 평이한 영어로 본 라이선스의 속성과 범위를 설명하기 위해 고안되었다. 그러나 이 서문이 본 라이선스의 일부를 구성하는 것은 아니다. 본 라이선스의 법적 효력은 라이선스의 규정에 의해서만 결정되며, 이 서문에 의해서는 좌우되지 않는다.

본 라이선스는 오픈 소스 정의를 준수하며, OSI(Open Software Initiative)에 의해 승인되었다. 본 라이선스에 의해 배포된 소프트웨어는 “OSI 인증 오픈 소스 소프트웨어라고 표시할 수 있다.

본 라이선스의 규정은 다음과 같다:

1. 당신은 라이선스된 제품을 단독으로, 또는 다른 여러 소스의 프로그램을 포함하는 집합적 소프트웨어 배포의 구성요소로서 사용, 판매 및 양도할 수 있다. 사용료나 기타 요금은 요구되지 않는다.

2. 선행 기여자에 의해 작성된 수정물을 포함하여, 라이선스된 제품의 소스코드와 실행파일 버전이 모두 사용될 수 있다. (“라이선스된 제품”, “수정물”, “기여자소스코드의 의미는 라이선스에 정의되어 있다.)

라이선스 조항

b. 기여자가 현재 또는 추후에 소유하거나 관리하는 특허 청구항에 따라 수정물이나 그 일부를 작성, 사용, 판매, 판매를 위한 청약 또는 기타 방식으로 처분하는 행위. , 이러한 행위는 그러한 청구항에 의해 당신이 수정물이나 그 일부, 또는 파생저작물을 작성, 사용, 판매, 판매를 위한 청약 및 기타 방식으로 처분할 수 있도록 하는데 필요한 정도로만 허용된다.

3라이선스 부여의 예외사항.

4. 배포와 관련된 당신의 의무.

d. 지식재산권 문제.

i. 3자 청구. 당신이 만약 어떤 제3자 지식재산권에 대한 라이선스가 본 라이선스에 의해 부여되는 권리들을 행사하는데 요구된다는 사실을 알고 있다면, 당신은 소스코드 배포 시에, 청구의 내용과 그 청구를 제기하는 당사자를 상세히 설명하여 수취인이 누구에게 연락을 취해야 할 지 알 수 있는, “LEGAL”이라는 제목의 텍스트 파일을 포함시켜야 한다. 만약 4(b)항에 설명된 바에 따라 수정물을 제공한 날 이후에 그러한 사실을 알게 되었다면, 그 이후에 만드는 모든 복제본의 LEGAL 파일을 즉시 수정하고, 당신으로부터 라이선스된 제품을 양도받는 사람들에게 새로운 정보의 입수를 알려줄 수 있을 만한 (예를 들어 적절한 메일링 리스트나 온라인 모임을 이용하는 등의) 적절한 조처를 취해야 한다.                               

ii. 기여자 API. 만약 당신의 수정물이 애플리케이션 프로그래밍 인터페이스(API)를 포함하고, 당신이 해당 API를 실행하는데 필요한 특허 라이선스에 대해 알고 있다면, 당신은 이 정보를 LEGAL 파일 내에 포함시켜야 한다. 

iii. 선언당신은 위의 4조의 (d) (i) 항에 제시된 경우를 제외하고, 당신의 수정물이 당신의 독창적인 창작이라고 믿으며, 본 라이선스에 의해 양도되는 권한을 부여할 충분한 권리가 당신에게 있음을 선언한다.  

e. 고지사항. 당신은 당신이 작성하거나 기여 및 배포한 수정물의 소스코드와 함께 제공되는 모든 문서 내에, 라이선스된 제품과 관련한 수취인의 권리를 설명하는 모든 부분에 본 라이선스의 사본을 포함시켜야 한다. 당신은 배포하는 라이선스된 제품의 소스코드의 각 파일 내에 Exhibit A의 고지 사항(“고지사항”)들을 복제해야 한다. 수정물을 작성한 경우, 당신은 고지사항에 당신의 이름을 기여자로 추가시킬 수 있다. 만약 특정 소스코드 파일의 구조적 속성으로 인해 고지를 포함시키는 것이 불가능할 경우, 당신은 사용자가 그러한 고지를 찾아볼 가능성이 높은 위치(관련 디렉토리 등)에 고지를 포함시켜야 한다. 당신은 선택적으로 라이선스된 제품을 양도받은 한 명 이상의 수취인에게 보증, 지원, 보상, 또는 책임의무를 제공하고, 이에 대한 요금을 청구할 수 있다. 그러나 이는 당신의 단독적인 책임으로만 가능하며, 당신이 라이센서나 다른 기여자를 대신하는 것은 허용되지 않는다. 당신은 그런 보증, 지원, 보상 또는 책임 의무가 당신에 의해서 단독으로 제공되는 것임을 절대적으로 명확하게 밝혀야 하며, 당신이 제공한 보증, 지원, 보상 또는 의무 규정으로 인해 라이센서나 어떤 기여자에 의해 야기된 모든 책임에 대하여, 라이센서와 해당 기여자를 면책시키는 데 동의해야 한다.

f. 실행 가능한 버전의 배포. 당신은 다음과 같은 조건들을 충족시킨다는 전제 하에, 본 라이선스와 상이한 규정들을 포함하는 다른 라이선스를 선택하여 그 라이선스에 따라 라이선스된 제품을 실행 프로그램의 형태로 배포할 수 있다: (i) 배포를 하는데 있어 제4조의 (a)에서 (e)항까지의 요구사항들을 충족시켜야 하고; (ii) 실행 가능한 버전, 관련 문서 및 이에 상응하는 자료 내에 라이선스된 제품의 소스 코드 버전이 본 라이선스의 규정에 따라 제공된다는 진술과 제4 (b)항의 의무들을 어떤 방식으로, 어떤 위치를 통해 충족시켰는지에 대한 설명을 포함시켜야 하며; (iii) 라이선스된 제품의 기존 저작권 표시들을 모두 유지시켜야 하며; (iv) 본 라이선스와 상이한 규정들은 라이센서나 다른 기여자가 아닌 당신이 단독으로 제공하는 것임을 명확하게 밝혀야 한다. 당신은 당신이 제공한 규정으로 인해 라이센서나 어떤 기여자에 의해 야기된 모든 책임에 대하여, 라이센서와 해당 기여자를 면책시키는 데 동의해야 한다.

g. 파생 저작물의 배포.

당신은 파생 저작물(예컨대 라이선스된 제품의 전체나 일부를 다른 코드와 결합한 결합물)을 작성할 수 있고, 라이선스된 제품이나 다른 수정물로 구성된 파생 저작물의 해당 부분에 대한 본 라이선스의 요구사항들이 충족된다는 전제 하에, 그 파생저작물을 당신이 선택하는 다른 라이선스에 따른 상품으로 배포할 수 있다.

5. 법률이나 규제로 인해 라이선스 규정을 준수할 수 없는 경우.

법률이나 법령 또는 규제로 인해 당신이 라이선스된 제품의 전체나 일부에 대하여 본 라이선스의 규정을 준수하는 것이 불가능할 경우, 당신은 (i) 가능한 최대한도로 본 라이선스의 규정을 준수하고; (ii) 당신이 라이선스를 준수하는 것을 제한하는 법률이나 규제를 열거하고, (iii) 제한되는 사항과 그것이 영향을 미치는 코드를 설명해야 한다. 이러한 설명은 제4 (d)항에 설명된 LEGAL 파일에 포함되어야 하며, 소스코드를 배포하는 모든 경우에 포함되어야 한다. 법률이나 규제에 의해 금지된 정도를 제외하고, 그러한 설명은 보통의 기술을 가진 수취인이 이해하는데 충분할 정도로 자세하게 이루어져야 한다.

6. 본 라이선스의 적용.

본 라이선스는 라이센서나 기여자가 Exhibit A의 고지사항을 첨부한 코드에 적용된다.

7. 본 라이선스의 버전.

a. 신규 버전 라이센서는 때때로 본 라이선스의 개정판이나 신규 버전을 공표할 수 있다.

b. 신규 버전의 효력. 라이선스된 제품이 라이선스의 특정 버전에 의해 공표되면, 당신은 언제나 해당 버전의 규정에 따라 그 제품을 지속적으로 사용할 수 있다. 당신은 또한 선택적으로 라이센서에 의해 공표된 모든 후속 버전의 규정에 따라 라이선스된 제품을 사용할 수도 있다. 본 라이선스에 의해 생성된, 라이선스 적용 코드에 적용 가능한 규정들을 수정할 수 있는 권한은 라이센서에게만 주어진다.

c. 본 라이선스의 파생 저작물. 당신이 본 라이선스의 수정 버전을 작성하거나 사용하는 경우 (이는 본 라이선스에 의해 구속되는 라이선스 적용코드가 아닌 코드에 적용시키기 위한 목적으로만 가능함), 당신은 당신의 라이선스에 새로운 이름을 붙여 본 라이선스와 유사하여 혼동되지 않도록 해야 하고, 당신의 라이선스가 본 라이선스와 상이한 규정들을 포함한다는 사실을 명확하게 밝혀야 한다. 당신의 라이선스에 이름을 붙일 때 라이센서나 다른 기여자의 상표를 사용해서는 안 된다.

8. 보증의 부인. 라이선스된 제품은 라이선스된 제품에 결함이 없다는 보증을 비롯하여, 상품성 여부나 특정 목적에 대한 적합성, 또는 비침해에 대한 보증을 제한 없이 포함하여, 어떤 종류의 명시적이거나 묵시적인 보증도 포함하지 않는 있는 그대로의 상태로 본 라이선스에 의해 제공된다. 라이선스된 제품의 품질과 작동과 관련된 모든 위험은 당신이 부담한다. 어떤 라이선스된 제품에 어떤 식으로든 결함이 있는 것으로 밝혀지는 경우, 필요한 수리나 교정, 또는 서비스 등에 소요되는 비용은 (라이센서나 다른 기여자가 아닌) 당신이 부담한다. 이 보증 부인 조항은 본 라이선스의 중요한 부분을 구성한다. 어떤 라이선스 적용코드도 본 부인 조항에 의하지 않는 한 사용이 허가되지 않는다.

9. 종료.

a. 위반에 의한 자동 종료. 본 라이선스와 여기에서 부여되는 권한들은 당신이 그 규정을 위반하고, 그러한 위반 사실을 인지한 날로부터 30일 이내에 위반 내용을 교정하지 않았을 경우, 자동적으로 종료된다. 본 라이선스가 종료되더라도, 합당하게 부여된 라이선스된 제품에 대한 서브라이선스들은 효력이 지속된다. 본 라이선스의 조항 중에서 그 속성 상 본 라이선스의 종료 이후에도 유효하게 지속되어야 하는 조항들은 효력이 지속된다.

b. 특허 침해 주장으로 인한 종료. 당신이 라이센서나 어떤 기여자(당신이 그런 소송을 제기하는 최초 개발자나 기여자는 피고라고 칭함)를 상대로, 라이선스된 제품이 직접적으로나 간접적으로 어떤 특허를 침해했다고 주장하는 (확인 판결을 제외한) 특허 침해 소송을 제기하는 경우, 그 피고가 본 라이선스의 제1조나 제2조에 따라 당신에게 부여한 모든 권한은 피고로부터 통지를 받은 날로부터 60(“통지 기한”) 이후에 종료될 것이다. , 당신이 그 통지 기한 이내에 서면으로, (i) 피고에 의해 작성된 라이선스된 제품에 대한 당신의 과거 및 추후 사용료를 상호가 합의한 적절한 금액으로 지불한다고 동의하는 경우, 또는 (ii) 라이선스된 제품에 대하여 피고를 상대로 제기한 소송을 철회하는 경우는 제외된다. 상기 통지 기한 내에 적절한 사용료와 지불 방식이 상호간에 서면으로 합의되지 않거나, 소송이 철회되지 않으면, 피고가 제1조와 제2조에 따라 당신에게 부여한 권한들은 상기 통지 기한이 종료되는 시점에 자동적으로 종료된다.

c. 본 라이선스의 합당한 가치. 당신이 피고를 상대로 라이선스된 제품이 직접적으로나 간접적으로 어떤 특허를 침해했다고 주장하는 특허 침해 클레임을 주장하는 경우 중에서, 그러한 주장이 특허 침해 소송을 시작하기 전에 (라이선스 또는 합의 등에 의해서) 해소되었을 경우, 지불 금액이나 라이선스의 가치를 결정하는데 있어 피고가 제1조나 제2조에 의해 부여한 라이선스들의 적절한 가치가 참작되어야 한다. 

d. 종료 효력의 소급 없음. 위의 제9조의 (a) 항이나 (b) 항에 의해 라이선스가 종료되는 경우라도, 당신이나 다른 배포자에 의해 라이선스에 따라 합당하게 부여된 최종 사용자 라이선스 계약서 (배포자와 재판매자에 대한 라이선스 제외)들은 전부 효력이 지속된다.

10. 책임의 제한. 사전에 손해 가능성을 알고 있었다 하더라도, 라이선스된 제품의 라이센서나 기여자, 배포자, 또는 해당 당사자들에 대한 공급자는 어떤 조건이나 법 이론에 의해서도, 불법행위(과실 포함), 계약 등과 관계 없이, 영업권 상실, 업무 정지, 컴퓨터 고장이나 비작동, 또는 기타 모든 상업적 손상이나 손해를 제한 없이 포함하는 간접적이거나 특수한 손해, 우발적이거나 결과적 손해에 대하여 누구에게도 책임을 지지 않는다. 이 면책 사항들은 적용 가능한 법률이 면책을 금지하는 한, 해당 당사자의 과실에 의해 발생한 사망이나 개인적 상해에는 적용되지 않는다. 우발적이거나 결과적 손해의 제한이나 면제를 허용하지 않는 재판관할지도 존재하므로, 이러한 제한이나 면제 사항이 당신에게 적용되지 않을 수도 있다.

9.  Termination.

a.  Automatic Termination Upon Breach. This license and the rights granted hereunder will terminate automatically if you fail to comply with the terms herein and fail to cure such breach within thirty (30) days of becoming aware of the breach. If within said Notice Period a reasonable royalty and payment arrangement are not mutually agreed upon in writing by the parties or the litigation claim is not withdrawn, the rights granted by Licensor to you under Sections 1 and 2 automatically terminate at the expiration of said Notice Period.
